The regulatory framework
From 1 November 2025, government-funded aged care is regulated under the rights-based Aged Care Act 2024 and the Aged Care Rules 2025, overseen by the Aged Care Quality and Safety Commission. Registered providers must meet the strengthened Aged Care Quality Standards that apply to their registration category: Standard 1 The individual, Standard 2 The organisation, Standard 3 The care and services, Standard 4 The environment, Standard 5 Clinical care, Standard 6 Food and nutrition, and Standard 7 The residential community. Providers must also uphold the Statement of Rights and comply with the Code of Conduct for Aged Care.
